iii TÓM TẮT LUẬN VĂN Luận văn "Bán đấu giá tài sản bảo đảm là quyền sử dụng đất liên quan đến hoạt động ngân hàng theo pháp luật thi hành án dân sự - thực tiễn thực hiện tại thành phố Hồ Chí Minh" nghiên cứu những nội dung cơ bản như sau: Những vấn đề lý luận cơ bản về BĐG TSBĐ là QSBĐ liên quan đến hoạt động NH theo pháp luật THADS bao gồm: Khái niệm, đặc điểm, nguyên tắc, vai trò, điều chỉnh của pháp luật về BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH ở các khía cạnh cụ thể là: Các biện pháp, thủ tục, thẩm quyền BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH theo pháp luật THADS. Bên cạnh đó, luận văn còn xác định các yếu tố ảnh hưởng đến BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH như Yếu tố chính trị, kinh tế, Yếu tố pháp lý, Yếu tố trình độ chuyên môn, văn hoá, nhận thức làm căn cứ để đánh giá thực trạng về BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH hiện nay. Phần thực trạng pháp luật BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH và thực tiễn thực hiện tại TPHCM tập trung vào các nội dung sau: Thực trạng pháp luật về BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH ở Việt Nam hiện nay trên các các khía cạnh thực trạng các quy định pháp luật về các biện pháp xử lý, thủ tục xử lý và thẩm quyền BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH. Đồng thời cũng đánh giá những thuận lợi, khó khăn vướng mắc trong quá trình thực hiện pháp luật về BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH của cơ quan THADS tại Thành phố Hồ Chí Minh cũng như tìm ra được những nguyên nhân của thuận lợi và khó khăn vướng mắc đó. Luận văn đưa ra một số phương hướng cũng như những giải pháp cụ thể nhằm hoàn thiện các quy định về BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH trong hoạt động THA ở Việt Nam và nâng cao hiệu quả thực hiện các quy định về bán đấu giá tài sản bảo đảm là BĐG TSBĐ là QSDĐ liên quan đến hoạt động NH ở TPHC,M hiện nay.
